Privacy Policy

Chonkster LLC (“Chonkster,” “we,” “us,” or “our”) develops and operates the Chonke Memes mobile application (the “App”).

Chonke Memes is designed to be suitable for users aged 4 and older, including children, when used with appropriate supervision by a parent or legal guardian.

This Privacy Policy explains how information is handled when you use the App, purchase a subscription through Apple, save content to your device, share content with another application, or contact us for support.

1. Information and Content Processed on Your Device

You do not need to create a Chonkster account to use the App.

To create video or GIF meme content, the App may process information that you choose to provide, including:

• Photos, videos, GIFs, or other media you select;
• Text, captions, timing choices, edits, effects, and formatting instructions;
• Draft meme projects; and
• Videos, GIFs, images, or other content generated by the App.

This content is processed locally on your mobile device. Chonkster does not receive, upload, view, or store this content on developer-controlled servers and does not operate a cloud service where your meme projects or media are stored.

Files you save remain under your control on your device or in any storage service you separately choose to use.

2. Device Permissions

Depending on the features you use, the App may request permission to access certain device functions.

Photos and media

The App may request permission to:

• Access photos or videos that you select for use in a meme;
• Add an exported video, GIF, or image to your photo library; or
• Open a file that you select through an Apple file-selection interface.

Where Apple provides a limited or selected-photos permission option, you may choose which items the App can access.

Camera and microphone

Where the App offers a recording feature, it may request access to your camera or microphone when you choose to record video or audio.

Camera and microphone content is processed on your device and is not transmitted to Chonkster.

Changing permissions

You may review or change permissions through the privacy settings on your device. Disabling a permission may prevent the associated App feature from working.

3. Saving and Sharing Your Content

You may choose to save content generated in the App to your device.

You may also choose to share content through Apple’s system sharing features. When you select another application or service from the sharing interface, your device sends the content to the destination you selected at your direction.

Chonkster does not receive a copy of content merely because you share it through another service. Chonkster also does not control how the selected social-media platform, messaging service, cloud-storage provider, or other third party handles the content after it is shared. That third party’s privacy policy and terms govern its subsequent handling of the content.

Children should use the App’s saving and sharing features only under the supervision of a parent or legal guardian.

A parent or legal guardian is responsible for deciding whether and where a child’s content may be shared and for ensuring that the child’s use of any third-party service complies with that service’s minimum-age requirements, privacy policy, and terms.

Children under 13 should not independently use the App to send content through email, social media, messaging applications, or other third-party services. Any such sharing should be controlled and initiated by a parent or legal guardian.

4. Subscriptions and Payments

Paid features in Chonke Memes may be offered through an auto-renewable subscription purchased through Apple’s App Store.

Apple processes subscription purchases, billing, payment credentials, purchase confirmations, cancellations, and refund requests. Chonkster does not receive or store your complete payment-card number, bank-account information, Apple Account password, or other payment credentials.

The App may use information supplied by Apple on your device to determine whether a subscription is active and to unlock the applicable features. Under the App’s current design, Chonkster does not store that subscription-entitlement information on a developer-controlled server.

Apple handles information associated with your Apple Account and App Store transactions under Apple’s own privacy policies and terms.

A subscription intended for use by a child must be purchased or approved by the child’s parent or legal guardian through the applicable Apple Account and Apple purchase controls.

Chonkster does not independently collect a child’s name, age, payment information, or a parent’s payment information in connection with a subscription.

5. Information We Do Not Collect Through the App

In addition to the media and payment information addressed above, Chonkster does not collect through the App:

• Your name, postal address, telephone number, or personal email address;
• Your contacts or address book;
• Precise or approximate location information;
• Advertising identifiers;
• Device fingerprints;
• Browsing history;
• Search history;
• Health, fitness, financial, or biometric information;
• Usage analytics associated with an identifiable device or person; or
• Advertising-interaction information.

Chonkster does not use the App to track you across applications or websites owned by other companies.

Apple may independently process App Store, device, subscription, diagnostic, or platform information in its role as the provider of iOS and the App Store. Apple’s handling of that information is governed by Apple’s own policies.

6. Information You Voluntarily Provide to Us

When you email us or otherwise contact us directly, we may receive:

• Your email address;
• Your name, if included in your email or email account;
• The contents of your message;
• Screenshots, recordings, files, or other attachments you choose to send; and
• Technical or device information you choose to include when requesting support.

We use this information only as reasonably necessary to:

• Respond to your question or support request;
• Investigate and resolve technical problems;
• Maintain records of support communications;
• Protect the security or integrity of the App;
• Establish, exercise, or defend legal rights; or
• Comply with applicable law.

We do not use support correspondence for targeted advertising, and we do not add you to a marketing list merely because you requested support.

Please do not send sensitive personal information that is not necessary for us to address your request.

7. Disclosure of Information

Because App content and activity are not transmitted to Chonkster, information voluntarily included in support communications is generally the only user information Chonkster may have available to disclose.

Such information may be processed or disclosed in the following limited circumstances.

Service providers

A service provider that hosts or operates our business email may process support correspondence on our behalf. Such a provider may use the information only to provide its services to us and subject to its applicable contractual and security obligations.

Legal obligations and protection

We may disclose information when we reasonably believe disclosure is necessary to:

• Comply with applicable law, a subpoena, court order, or other valid legal process;
• Respond to a lawful request from a government authority;
• Protect the rights, property, or safety of Chonkster, our users, or others;
• Investigate suspected fraud, abuse, security incidents, or violations of our Terms of Service; or
• Establish, exercise, or defend legal claims.

Business transactions

If Chonkster is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of some or all of its assets, limited business records may be transferred as part of that transaction, subject to applicable law.

8. No Sale or Advertising Sharing

Chonkster does not sell personal information.

Chonkster also does not share personal information for cross-context behavioral advertising or targeted advertising and does not use personal information to build advertising profiles.

Because we do not engage in these practices, we do not offer a separate “Do Not Sell or Share My Personal Information” mechanism.

9. Data Retention

Chonkster does not retain your meme projects, source media, or exports because those materials are not transmitted to us.

Content saved to your device remains there until you delete it or until it is removed through your device, backup, storage-provider, or operating-system settings. Removing the App may not delete content that you previously exported to your photo library, Files application, cloud storage, or another application.

We retain support correspondence only for as long as reasonably necessary to:

• Respond to and document the request;
• Resolve recurring technical issues;
• Maintain security and business records;
• Comply with applicable law; or
• Establish, exercise, or defend legal rights.

Retention periods may vary based on the nature of the communication and any applicable legal obligation.

10. Access, Correction, and Deletion Requests

Because Chonkster does not maintain App accounts or store your App projects, we ordinarily do not possess App data that can be accessed, corrected, or deleted on your behalf.

You can manage locally stored content directly on your device.

To request access to or deletion of support correspondence that you previously sent us, contact us at socials@chonke.meme. We may need enough information to locate the relevant communication and verify that the request relates to you.

We may retain information where retention is required or permitted by law, including for security, fraud prevention, recordkeeping, or legal claims.

Depending on where you live, you may have additional privacy rights. We will consider verifiable requests in accordance with applicable law.

11. Children’s Privacy

The information practices described throughout this Privacy Policy apply equally to children who use the App.

Parents and legal guardians should supervise a child’s use of the App, manage the App’s device permissions and subscription access, and control whether and where the child’s content is shared, as described in Sections 2 through 4.

The App’s support contact is intended for use by adults. Children under 13 should not contact Chonkster directly or include their name, email address, photograph, video, voice, location, school information, or other personal information in a support request. A parent or legal guardian should contact us on the child’s behalf.

If we learn that we have received personal information directly from a child under 13 without appropriate parental authorization, we will take reasonable steps to delete that information, except where retaining limited information is required or permitted by law, necessary to protect the child or another person, or necessary to respond to a legal or security matter.

A parent or legal guardian who believes that a child has provided personal information to us may use the contact information in Section 15 to request that we review and, where appropriate, delete the information.

Parents and legal guardians may review or delete content saved locally on a child’s device using the device’s normal photo, file, application, or parental-control settings.

12. Security

No method of electronic communication or storage is completely secure.

For information voluntarily sent to us, we use reasonable administrative, technical, and organizational measures appropriate to the nature of that information.

You are responsible for maintaining the security of your device, Apple Account, email account, social-media accounts, and any services through which you save or share content.

13. International Users

Chonkster is based in the United States.

If you contact us from outside the United States, your support communication may be processed in the United States or another country in which our email or service providers operate. Those countries may have data-protection laws that differ from those in your jurisdiction.

Where required, we will handle personal information in accordance with applicable data-protection law.

14. Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes to the App, our practices, legal requirements, or other operational needs.

When we make changes, we will update the “Last Updated” date above. Where required by law, we will provide additional notice of a material change.

Your continued use of the App after the updated policy becomes effective is subject to the updated policy, except where applicable law requires another form of notice or consent.
